You employ staff who are subject to LOB and have not joined a new occupational benefits scheme immediately after terminating the expired agreement with no interruptions.
If we have to assume that your company employs staff who are subject to LOB, existing laws compel us to initiate a compulsory membership process at your expense to ensure that your staff are covered with no gaps.
Your company will receive a compulsory membership order in the next few days. If you are then able to demonstrate within 30 days that you have a membership agreement with a new occupational benefits organisation that follows on from your old one, you will be entitled to submit a request for reconsideration.
Otherwise your company will become a compulsory member of our joint foundation. If you wish to contest this, you may appeal to the Federal Administrative Court. Please note that the costs of these proceedings may be awarded against you.
